Privacy Policy

This policy references the information we process on www.codemastersinc.com (our “Website”), which is provided by CodeMasters Agency inc. and our affiliates. 

This policy also applies to information we collect, use, or disclose about you:

  • On this Website;

  • Part of our commercial electronic message; and

  • When you interact with our advertising on third-party websites and services.

Personal Information

For the purposes of this Policy, the term “Personal Information” means any information that is defined to be personal information under applicable privacy laws. Usually, this refers to any information about an identifiable individual or any information that can be used to identify an individual and may include, for example, your name and home address, your date of birth and gender, health information, your occupation, medical conditions or other health information, your personal financial records or credit information, or any personal identification numbers.

In most circumstances, Personal Information does not include the business contact information of a representative of an organization, such as the representative’s name, position or title, business address, business telephone number or business fax number. Publicly available information, such as information in a public directory, is not Personal Information under this Privacy Policy.

Purposes

Our Site does not automatically gather Personal Information from you. We would only obtain this information if you supplied it to use by sending an email or by filling out a form in a secure portion of the Site.

We may collect, use or disclose personal information for the purposes identified at the time of collection, as otherwise permitted or required by applicable law, or for any of the following purposes:

  • to provide Services to you or to allow you to access to the Site;

  • to comply with our legal obligations and regulatory requirements;

  • to provide information to anyone working with or for us as needed for the provision the Services;

Consent

Privacy legislation requires that we obtain the consent of an individual for the collection, use or disclosure of Personal Information in many circumstances. By providing your Personal Information to us, you agree that we may collect, use and disclose your Personal Information in accordance with this Policy and as otherwise permitted or required by law, and that we may access, process and store your Personal Information in Canada or another jurisdiction.

When we receive Personal Information from you for the purposes of providing you with the Services, or for other uses identified herein, you are providing us with consent as follows:

  1. to allow us to deal with that Personal Information in a reasonable manner;

  2. to allow us to provide your Personal Information to third parties we engage to provide or support the Services;

  3. to allow us to use and store your Personal Information for the purpose of providing you with the products and Services you purchase from us and to utilize the Services; and

  4. to allow us to transfer your Personal Information outside of Canada (whereby your Personal Information will be treated in accordance with applicable foreign laws) for the purpose of storage and use of your Personal Information by the Company.

If you need to provide us with Personal Information about other individuals, you represent and warrant to us that, where required by law and prior to your disclosure to us, you will obtain the consent of each individual to the collection, use and disclosure by us for the specific purpose(s) that the disclosure is made by you.

Providing us with your Personal Information is always your choice. When you request Services from us, or utilize our Services, we ask that you provide information that enables us to respond to your request and/or provide you with our Services. In doing so, you consent to our collection, use and disclosure to appropriate third parties of such Personal Information for these purposes. If we sell our organization or merge with another party, your consent will be implied to transfer your information to our successor for the same purposes as set out in this Policy.

Consent Exceptions

There are legal exceptions where we will not need to obtain consent or explain the purposes for the collection, use or disclosure of Personal Information. Some examples of situations where consent is not required include an emergency that threatens the life, health or security of an individual, or if we must comply with a court order or governmental order.

Limited Collection

We will only collect such information that is deemed necessary to meet the purpose for which such Personal Information is collected.

Limited Use, Disclosure and Retention

We will only use your Personal Information in accordance with this Policy. If in the course of managing its business operations, we share your Personal Information with professional advisors, franchisees, suppliers, any such entities shall be required to comply with privacy guidelines that impose obligations at least commensurate with this Policy. Cookies

The Company may occasionally use cookies to track how its visitors use the Site or to determine the website previously visited. Cookies are fragments of information sent to Users computer when a website is viewed. These are traces of the Users’ visits that are recorded either temporarily or permanently on their hard drive and may include the date and time of the last visit, among other things. Cookies contribute to improving Users’ online experience by recording browsing preferences on a particular website. The Site will notify you before any cookies are used, so that you may refuse them. A refusal of cookies will not affect the Site performance or restrict a User’s ability to access information on the Site.

Cookies left on Users’ hard drive are harmless and may be read or deleted at any time. Users therefore have complete control over them. The information allows the Company to determine the total number of visitors to each web page and the time spent on it. Every time Users go to a website, a cookie is created and left on their computer, therefore allowing the Company to “recognize” them.

The Services may use retargeting services (for example Google Analytics) to identify Users who have used the Services and reach them with online advertising once they have stopped using the Services, in order to transmit advertisements associated with prior use of the Services, without however disclosing any Personal Information in doing so.

The Site may contain links to other websites operated by third parties. Please note that this Policy applies only to the Personal Information that we collect or receive from third parties with your consent and we cannot be responsible for personal information that third parties may collect, store and use, including through their websites. You should always read the privacy policy of each website you visit carefully.
